(1) On page 38 line 3, after the word "applicable." by inserting the following language; "A judge or magistrate shall not issue a body attachment for any judgment entered prior to the effective date of this section."

(2) On page 38, line 6, by striking the semicolon and all of the language on said line, and all of the language appearing on lines 7 through 10, inclusive, and substituting therefor the following language:

"In the event that a body attachment is executed, the detainee must be brought before a judge or magistrate, or if the traffic tribunal is not in session before a justice of the peace authorized pursuant to section 12-10-2 immediately upon detention or as soon thereafter as is reasonably practicable. The amount of fees and fines due to the traffic tribunal shall be noted on a body attachment issued pursuant to this procedure, and a justice of the peace shall accept said monies and order the release of the detainee if the amount due is tendered. If the detainee claims an inability to pay the full amount due, the justice of the peace shall order the release of the detainee pursuant to reasonable bail. The chief judge of the district court shall issue rules and regulations for the collection process consistent with this section."

Such fraud examination shall be performed by a member(s) in good standing with the Association of Certified Fraud Examiners, and shall be conducted in accordance with standards of the Association of Fraud Examiners. The fraud examiner(s) shall be directed to investigate the disposition of traffic tickets and the handling of cash and checks received at the former court. The fraud examiner(s) shall determine the existence of fraud indicators, if any, and shall develop evidence of fraud to the extent practical for each fraud indicator. The fraud examiner(s) shall be directed to report evidence of fraud to the Department of the Attorney General within forty-eight (48) hours of the evidence's discovery. The services of the fraud examiner(s) shall be commissioned by the Department of Purchasing in accordance with rules and regulations of the Department of Purchasing for purchasing consultant services."
