(2) Estuary and coastal habitats are the complex of physical and hydrologic features and living organisms that combine within estuaries and other coastal areas to provide food, nesting and resting areas, and shelter for fish and wildlife. Types of habitat include, but are not limited to, freshwater and coastal wetlands, tidal flats, natural shorelines, shellfish beds, seagrass meadows, kelp beds, river and tidal deltas, and river and stream banks under tidal influence.

(3) Degraded estuary and coastal habitat means habitat that has reduced ecological functioning due to impairment caused by the activities of humans.

(4) Restoration means the act, process, or result of returning an estuary and coastal habitat to a condition as close to its condition prior to impairment as reasonably possible and/or improving degraded estuary and coastal habitats (including both physical and functional restoration), with the goal of attaining improvements for the benefit of fish and wildlife resources. Restoration activities may include, but are not limited to, the reestablishment of physical features and hydrologic functions, the chemical clean-up of toxic deposits, control of non-native and invasive species and reintroduction of native species through plantings or natural succession, particularly re-vegetation of seagrass, removal of barriers or construction of fish ladders to provide passage for spawning or migrating fish or controlling, reducing, or eliminating other specific adverse impacts and other activities that improve estuary habitat.".

On page 3, line 6 after the word "The" delete the word, "Plan" and replace it with the word "Strategy" and after the word "restoration" delete the word "plan" and replace with the word "strategy".

On page 3, lines 9, 10 and 11, delete the sentence beginning with the word "Twenty-five" and ending with the word "trust" and insert in place thereof the language: "On or before August 1, 1999, not more than three hundred fifty thousand dollars ($350,000) of the fees shall be transferred from the oil spill response and prevention fund to the estuary and coastal habitat restoration trust fund. "(A) Funding of Estuary and Coastal Habitat Restoration Activities. - Factors to be taken into I account by the technical committee for the purposes of granting monies for estuary and coastal habitat restoration activities, determining the eligibility of an estuary and coastal habitat restoration projects for financial assistance, and in prioritizing the selection of estuary and coastal habitat restoration projects by the technical committee;

(1) consistency with the State Estuary and Coastal Habitat Restoration Strategy, the Narragansett Bay Comprehensive Conservation and Management Plan, the State Coastal Nonpoint Pollution Control Plan, the Coastal Resources Management Program, the Department of Environmental Management regulations, and pertinent elements of the state guide plan;

(2) the ability of the applicant to provide adequate personnel, funding, and authority to carry out and properly maintain the estuary and coastal habitat restoration activity;

(3) the proposed monitoring plan to ensure that short-term and long-term restoration goals are achieved;

(4) the effectiveness of any nonpoint source pollution management efforts upstream and the likelihood of re-impairment;

(5) whether the estuary and coastal habitat restoration activity can be shown to replace habitat losses that benefit fish and wildlife resources;

(6) potential water quality improvements;

(7) potential improvements to fish and wildlife habitats for species which are identified as rare or endangered by the Rhode Island Natural History Survey or the federal Endangered Species Act:

(8) the level and extent of collaboration by partners e.g., municipality, nongovernment organization, watershed council, federal agency etc.;

(9) potential direct economic benefit to a community or the state.

(B) There shall also be established a license fee for the Estuary and Coastal Habitat Restoration Trust Fund plate which will be available at the Division of Motor Vehicles:

(1) the registrar of motor vehicles is hereby empowered and authorized to make available to every owner of a motor vehicle eligible for registration as an automobile or eligible for registration as a commercial vehicle plates designated as "Estuary and Coastal Habitat Restoration Plate" upon application on proper forms furnished by the registrar. The Estuary and Coastal Habitat Restoration plate shall display upon them the same registration number assigned to the vehicle for which it was issued, and shall be used in place of and in the same manner as the registration plates issued to the vehicle for the period the registration remains active. Upon issuance of said Estuary and Coastal Habitat Restoration plates, the original registration plates for the vehicle shall be removed from the vehicle and returned to the registry for destruction.

(2) The color and design of the special plates shall be determined by the registrar of motor vehicles. A service charge in the amount of forty dollars ($40.00) shall be required upon application, with twenty dollars ($20.00) of the service charge being deposited in a restricted receipt account, established within the general fund to be used solely for the Estuary and Coastal Habitat Restoration Trust Fund and twenty dollars ($20.00) being allocated to the registry of motor vehicles for its costs in manufacturing and distributing the special plates.

(3) The owner of a motor vehicle eligible for registration as an automobile that is issued alternative plates shall cOntinue to pay the appropriate automobile registration fee for the plates. The owner of a motor vehicle eligible for registration as a commercial vehicle that is issued alternative plates shall continue to pay the appropriate commercial registration fee for the plates pursuant to section 31-3-11."

{ADD 46-15.7-1. Legislative findings and declaration. -- ADD} (A) The general assembly finds that:

(1) The Constitution of the state of Rhode Island charges the general assembly with responsibility for the conservation of all natural resources, including water.

(2) The supply of fresh water available to the people of Rhode Island for use in their daily lives and to support agriculture, hydropower, indigenous wildlife and plant species, navigation, water-based recreation, wetlands, and other uses is finite and is not equally available or accessible throughout the state.

(3) A significant portion of the fresh water resource of the state is already being used to serve a variety of needs and purposes and the total volume and quality of the remaining fresh water resource of the state is subject to quantitative, qualitative, or geographic constraints on its availability or use.

(4) Allocation of the water resource of Rhode Island has thus far been accomplished on a random, first come, first served, or ad hoc basis with minimal or no consideration given to overall allocation of the resource so as to meet all present and foreseeable future needs.

(5) All of the data needed to properly manage the allocation and use of the water resource of the state are not available. The responsibility to provide essential data rests primarily upon those who withdraw and use the waters of the state.

(B) Therefore, the general assembly declares that:

(1) Management of the amounts, purposes, timing, locations, rates, and other characteristics of fresh water withdrawals from ground or surface waters is essential in order to protect the health, safety, and general welfare of the people of the state of Rhode Island, to promote the continued existence, diversity, and health of the state's native wildlife and plant species and communities, and the fair and equitable allocation of the water resource among users and uses, and to insure that long-range rather than short-range considerations remain uppermost.

(2) To support these objectives adequate data is essential to determine the capabilities of the states water resources to support various uses and users and the quantities of water needed for these uses.

(3) This requirement shall be carried out by management of fresh water resources of the state based on long-range planning for and conservation of these resources; fairness, equitable distribution, and consideration for all human uses; matching the use of water with the quality of water necessary for each use, giving priority to those uses that require the highest quality water; maintenance of native aquatic and terrestrial animal and plant species, populations, and communities and statewide diversity; continued upholding of and improvement in the quality of the environment and especially of the water resources itself; and careful integration with all other social, economic, and environmental objectives, programs, and plans of the state.

{ADD (4) With regard to agriculture: it is a priority of the state to preserve agriculture; securing this state priority involves allocation of water resources in a manner that provides for agricultural sustainability while recognizing the importance of other water uses, and accordingly, in any program by which water withdrawals may be allocated by the board pursuant to its powers, including but not limited to powers set forth in chapters 46-15, 46-15.1, 46-15.3 and 46-15.7, the board shall give priority to commercial agricultural producers, as defined in section 46-15.3-4(2), that have adopted and implemented and agricultural water withdrawal management plan which has been approved by the department of environmental management, division of agriculture. In putting into effect the purposes of this paragraph, the board shall consider the reduction in water withdrawal that has resulted from the implementation of such an agricultural water withdrawal management plan as a credit against any reduction in water withdrawal which would otherwise be required; and to the extent not consistent (a) with the board's obligations to assure drinking water supplies under chapter 46-15.3 and water supplies for fire protection and (b) with federal and state law, the board shall allow such commercial agricultural producers to continue to irrigate commercial crops either in fields or greenhouses, notwithstanding a critical dry period. ADD}"

I hereby move to amend (99-H 5285 as amended) entitled "AN ACT RELATING TO HEALTH AND SAFETY REGISTRATION OF NURSING ASSISTANTS", as follows:

By deleting all of the language following the enactment clause and inserting in place thereof the following:

SECTION 1. Section 32-17.9-6 of the General Laws in Chapter 23-17.9 entitled "Registration of Nursing Assistants" is hereby amended to read as follows:

23-17.9-6. Registration. - Every nursing assistant being employed as a nursing assistant or offering services as a nursing assistant must obtain a certificate of registration issued by the department. Every nursing assistant, prior to being issued a certificate of registration by the department, shall successfully complete the training program and/or qualifying examination as hereinbefore required by sections 23-17.9-3 and 23-17.9-5 of this chapter unless otherwise exempt from the requirements. All applicants not otherwise exempted as above shall be required to successfully complete the required examination within a period of one (1) year from the date of initiation of training. Failure to successfully complete this process within one (1) year shall require that the applicant repeat the training program and be retested. All nursing assistants shall be registered with and qualified by the department of health. The fee for registration shall be $20.00. The department shall keep a register in which shall be entered the names of all persons to whom certificates of registration are issued under this chapter and the register shall be open to public inspection. In addition, if required by federal mandate the department will also keep a separate nurse aide registry.

SECTION 2. This act shall take effect on July 1, 2000.
