RELATING TO PROBATE COURTS

It is enacted by the General Assembly as follows:

SECTION 1. Section 8-9-10 of the General Laws in Chapter 8-9 entitled "Probate Courts" is hereby amended to read as follows:

8-9-10. Appointment and supervision of temporary custodians of decedents' estates -- Every probate court may appoint any suitable person or persons as custodian or custodians to have the charge and care of the real and personal property of deceased persons, the settlement of whose estates is within the jurisdiction of the court, until letters testamentary, or of administration, are granted; and may require the custodians to give bond to the court, with or without surety or sureties, in its discretion; and may also, in its discretion, authorize the custodians to sell any property which is perishable, or can be kept only at disproportionate expense, that may come to their possession by virtue of the appointment, and to take such other action as the court may direct; and the custodians shall in all things be subject to the control of the court and act under its direction, and shall receive a reasonable compensation out of the estate.

SECTION 2. This act shall take effect upon passage and shall apply to all decedents' estates.
