RELATING TO USE OF TOBACCO BY MINORS

It is enacted by the General Assembly as follows:

SECTION 1. Section 11-9-14 of the General Laws in Chapter 11-9 entitled "Children" is hereby amended to read as follows:

11-9-14. Use of tobacco by minors -- No person under sixteen (16) eighteen (18) years of age shall smoke or chew or possess when such possession is clearly visible tobacco in any form in any public street, place, or resort. Any person under sixteen (16) eighteen (18) years of age violating the provisions of this section shall be fined not more than five dollars ($5.00) for each offense.

SECTION 2. This act shall in no way be construed to restrict the otherwise legal sale of tobacco by a licensed tobacco retailer or by a person under the age of eighteen (18) employed to sell tobacco by a licensed tobacco retailer.

SECTION 3. This act shall take effect upon passage.
