RELATING TO THE WARWICK SEWER AUTHORITY

It is enacted by the General Assembly as follows:

SECTION 1. Section IV of chapter 13 of the Public Laws of 1983 entitled "An Act Authorizing the City of Warwick Sewer Authority to Implement an Industrial Waste Pre-Treatment Program" as amended, is hereby further amended to read as follows:

SECTION IV. PENALTIES

Any industrial user which shall fail to comply with any of the regulations enacted by the authority, shall fail to comply with a requirement of a permit issued by the authority, or shall fail to comply with any order duly made by the authority pursuant to its regulations, shall be subject to a penalty of $50.00 twenty-five thousand dollars ($25,000) per day for each day of non-compliance which penalty may be recovered in a civil action brought by the authority in the Kent County superior court. This right of the authority to seek civil penalties shall be in addition to the right of the sewer authority to seek injunctive relief. In addition, any industrial user shall be liable for any damages caused by non-compliance and shall be liable for reasonable attorney fees of the authority seeking compliance, penalties or damages.

SECTION 2. This act shall take effect upon passage.
