A N A C T

RELATING TO BUSINESSES AND PROFESSIONS -- NURSES

     

     

     Introduced By: Senators Polisena, McCaffrey, Tassoni, Ciccone, and Badeau

It is enacted by the General Assembly as follows:

 

     SECTION 1. Section 5-34-40 of the General Laws in Chapter 5-34 entitled "Nurses" is

hereby amended to read as follows:

     5-34-40. Certified registered nurse practitioner joint practice advisory committee. –

Advanced practice nurse advisory committee. -- (a) The seven (7) nine (9) member committee

consists of three (3) physicians, three (3) two (2) certified registered nurse practitioners, two (2)

certified registered nurse anesthetists, two (2) psychiatric and mental health clinical nurse

specialists, one (1) physician and one two (2) consumers. The governor appoints three (3)

physicians to the committee from the following specialties -- adult medicine, pediatric medicine,

and obstetrical-gynecological medicine. The governor appoints three (3) certified registered nurse

practitioners from the following specialties -- adult nurse practitioner, pediatric nurse practitioner,

and obstetrical-gynecological nurse practitioner. The director of health shall appoint the

committee. In making appointments to the committee, the director shall consider persons

recommended by professional nurse organizations and professional medical associations. The

professional members of the committee are currently engaged in practice. a collaborative certified

registered nurse practitioner-physician care practice. The consumer member is appointed by the

director of the department of health of the state. The consumer member is members are (1)

knowledgeable in consumer health concerns; (2) a resident of the state; (3) not licensed as a

health care practitioner; (4) not a parent, spouse, sibling, or child of a person licensed as a health

care practitioner, and not a student in a professional program; (5) not having a direct financial

interest in health care services; (6) not a member or an employee of any board of control of any

public or private health care service.

      (b) Each member appointment is for three (3) years, with no member serving more than

two (2) consecutive three (3) year terms except that in making the initial appointments the

director designates: four (4) members for a term of two (2) years; three (3) members for a term of

three (3) years; and the consumer members for three (3) year terms.

      (c) This committee must meet not fewer than two (2) times per year. The committee has

the following functions:

      (1) To assess nurse practitioner joint primary care advanced nursing practice for the

purpose of improving patient care.

      (2) Review To review all complaints regarding certified registered nurse practitioners,

advanced practice nurses, and recommend any and all disciplinary or corrective action that they

deem appropriate, including revocation and suspension of certification license, upon proof that a

an advanced practice nurse practitioner has:

      (i) Aided or abetted an uncertified person to practice as a an advanced practice nurse

practitioner;

      (ii) Become addicted to the use of liquor or controlled substances;

      (iii) Negligently, willfully, or intentionally acted in a manner inconsistent with the health

and safety of persons entrusted to his or her care;

      (iv) Had his or her authorization to practice as a an advanced practice nurse practitioner

denied, revoked or suspended in another state;

      (v) Engaged in the performance of medical functions beyond the scope of practice

authorized by the provisions of this chapter;

      (vi) Willfully failed to file or record medical records and reports; or

      (vii) Mental incompetence. ; or

     (viii) Willfully failed to maintain standards established by the nursing profession.

      (3) The recommendation is submitted to the board of nursing for implementation.

      (4) Report Advises periodically to the board of nurse registration and nursing education

regarding advanced certified registered nurse practitioner practice.

     SECTION 2. Section 5-34.2-6 of the General Laws in Chapter 5-34.2 entitled "Nurse

Anesthetists" is hereby repealed.

     5-34.2-6. Advisory committee. -- An advisory committee which is an adjunct of the

board is established consisting of seven (7) members: three (3) of whom are certified registered

nurse anesthetists currently practicing in Rhode Island; one of whom is a surgeon currently

practicing in Rhode Island; one of whom is an anesthesiologist currently practicing in Rhode

Island; one of whom is the president of the Rhode Island medical society or his or her designee;

and one of whom is a member of the general public currently residing in Rhode Island.

Appointments to the advisory committee are by the governor who appoints, from the certified

registered nurse anesthetist members, a chairperson. Members serve without compensation.

Appointments are for a period of two (2) years. The board consults with the advisory committee

on matters related to nurse anesthesia.

     SECTION 3. This act shall take effect upon passage.
