A N A C T

AMENDING THE INCORPORATION OF THE NORTH CUMBERLAND FIRE DISTRICT

It is enacted by the General Assembly as follows:

 

     SECTION 1. Sections 4 and 6 of the Acts and Resolves of 1978 entitled "An Act

Amending the Incorporation of North Cumberland Fire District" as amended are hereby amended

to read as follows:

     Sec. 4. Said electors at each annual district meeting, or in the case of vacancies, at any

special meeting, shall elect officers to serve one (1) year and until their successors are elected and

qualified, which officers shall consist of a moderator, clerk, treasurer, three (3) assessors of taxes

and a collector of taxes whose duties and powers within said district shall be the same that like

officers of towns in this state have within their respective town and shall also elect a board of

trustees consisting of eight (8) members with four (4) terms of which initially two (2) shall be

elected for one (1) year, two (2) elected for two (2 years, two (2) elected for three (3) years, and

two (2) elected for four (4) years. Each subsequent election of trustees will be for four (4) years.

Vacancies will be filled for the unexpired term of trustee only. Present office holders shall serve

until their present term expires.

     Such board of trustees shall have the authority and obligations of a board of directors as

set forth in section 7-1.1-33 of the general laws, and each trustee must be a qualified member of

the fire district and shall not be a member of the North Cumberland Fire Department.

     Sec. 6. The trustees shall appoint officers to serve at their discretion and until their

successors are appointed and qualified, which officers consist of a moderator, clerk, treasurer,

three (3) assessors of taxes and a collector of taxes whose duties and powers within the district

shall be the same that like officers in this state have within their respective town. The trustees

may elect such other officers and committees as they may deem necessary and shall have general

supervision and management of the business and affairs of the district and in the case of

vacancies in any office shall have the power to elect some qualified person to the office who shall

hold the same until his successor is qualified and elected.

     SECTION 2. This act shall take effect upon passage.
