A N A C T

RELATING TO LABOR - PRIVACY PROTECTION

It is enacted by the General Assembly as follows:

 

     SECTION 1. Title 28 of the General Laws entitled "Labor and Labor Relations" is hereby

amended by adding thereto the following chapter:

 

     CHAPTER 6.12

PRIVACY IN PRIVATE SPACES

 

     28-6.12-1. Employee privacy protection. -- (a) No employer may cause an audio or

video recording to be made of an employee in a restroom, locker room, or room designated by an

employer for employees to change their clothes, unless authorized by court order.

     (b) No recording made in violation of this section may be used by an employer for any

purpose.

     (c) In any civil action alleging a violation of this chapter, the court may:

     (1) award damages and reasonable attorneys' fees and cost to a prevailing plaintiff; and

     (2) afford injunctive relief against any employer that commits or proposes to commit a

violation of this chapter.

     (d) The rights and remedies provided herein shall be in addition to, and not supersede,

any other rights and remedies provided by statute or common law.

 

     SECTION 2. This act shall take effect upon passage.
