A N A C T

RELATING TO INSURANCE -- SMALL EMPLOYER HEALTH INSURANCE

AVAILABILITY ACT

It is enacted by the General Assembly as follows:

 

     SECTION 1. Section 27-50-13 of the General Laws in Chapter 27-50 entitled "Small

Employer Health Insurance Availability Act" is hereby amended to read as follows:

 

     27-50-13. Waiver of certain state laws. -- No law requiring the coverage of a health

care service or benefit, or requiring the reimbursement, utilization, or inclusion of a specific

category of licensed health care practitioner, applies to an economy or standard health benefit

plan delivered or issued for delivery to small employers in this state pursuant to this chapter.

Notwithstanding the foregoing, the benefits for mastectomy treatment mandated in sections 27-

18-39, 27-19-34 and 27-41-43 shall be added to the benefits in section 27-50-10 for both the

standard and economy health benefit plans.

 

     SECTION 2. This act shall take effect upon passage and shall apply to standard and

economy health benefit plans issued, delivered or renewed on or after January 1, 2006.
