A N A C T

RELATING TO BUSINESS AND PROFESSIONS -- MOTOR VEHICLE REPAIR SHOPS

     It is enacted by the General Assembly as follows:

 

     SECTION 1. Chapter 5-38.3 of the General Laws entitled "Motor Vehicle Repair Shop

Act" is hereby amended by adding thereto the following section:

 

     5-38.3-8. Notices required to be displayed. – (a) Any person operating a motor vehicle

repair shop and/or motor vehicle body and frame repair shop shall display in a conspicuous place

in the shop a sign in boldfaced type in letters at least two (2) inches high reading substantially as

follows:

     "PURSUANT TO RHODE ISLAND INSURANCE LAW, AN INSURANCE

COMPANY MAY NOT REQUIRE THAT REPAIRS BE MADE TO A MOTOR VEHICLE BY

A PARTICULAR PERSON OR REPAIR SHOP."

      (b) The failure to display a sign as required by this section shall be deemed to be an

unfair sales practice pursuant to the provisions of chapter 6-13, "Unfair Sales Practices," and a

deceptive trade practice pursuant to the provisions of chapter 6-13.1, "Deceptive Trade

Practices."

 

     SECTION 2. This act shall take effect upon passage.
