S E N A T E  R E S O L U T I O N

RELATING TO INSURANCE -- MOTOR VEHICLE DAMAGE APPRAISERS

     

     

     Introduced By: Senators Damiani, Polisena, and Sosnowski

     RESOLVED, That a special legislative commission be and the same is hereby created to

study and to make recommendations to the general assembly regarding the merits of pre-

insurance inspection and photographs of certain vehicles under section 27-10.1-10 of the Rhode

Island General Laws. The commission shall consist of nine (9) eleven (11) members as follows:

one (1) of whom shall be a member of the Senate, to be appointed by the President; one (1) of

whom shall be a member of the House of Representatives, to be appointed by the Speaker; one

(1) of whom shall be a representative of the pre-insurance inspection providers; one (1) of whom

shall be a representative of an underwriting department of an insurance carrier; one (1) of whom

shall be a member representing a Special Investigations Unit of an insurer’s claims department;

one (1) of whom shall be the Superintendent of the Rhode Island State Police, or his/her designee;

one (1) of whom shall be the chief of the Registry Division of Motor Vehicles or his/her

designee; one (1) of whom shall be a member of the general public, to be appointed by the Senate

President; and one (1) of whom shall be a member of the general public, to be appointed by the

Speaker of the House.; one (1) of whom shall be a representative of the Independent Insurance

Agents of Rhode Island; and one (1) of whom shall be a company representative.

     In lieu of any appointment of a member of the legislature to a permanent advisory

commission, a legislative study commission, or any commission created by a general

assembly resolution, the appointing authority may appoint a member of the general public to

serve in lieu of a legislator; provided, that the Majority Leader or the Minority Leader of the

same political party which is entitled to the appointment consent to the appointment of the

member of the general public.

     The purpose of said commission shall be to study the merits of pre-insurance

inspection and photographs of certain vehicles under Section 27-10.1-10 of the Rhode Island

General Laws.

     Forthwith, upon passage of this resolution, the members of the commission shall meet at

the call of the Senate President and organize and shall select, from among the legislators, a

chairperson. Vacancies in said commission shall be filled in like manner as the original

appointment.

     The membership of said commission shall receive no compensation for their services. All

departments and agencies of the state shall furnish such advice and information, documentary and

otherwise, to said commission and its agents as is deemed necessary or desirable by the

commission to facilitate the purposes of this resolution.

     The Senate President is hereby authorized and directed to provide suitable quarters for

said commission; and be it further

     RESOLVED, That the commission shall report its findings and recommendations to the

Senate on or before March 1, 2006 and shall expire May 1, 2006.
