A N  A C T

RELATING TO REGULATORY POWERS OF ADMINISTRATION -- KENT COUNTY WATER AUTHORITY

It is enacted by the General Assembly as follows:

 

     SECTION 1. Chapter 39-3 of the General Laws entitled "Regulatory Powers of

Administration" is hereby amended by adding thereto the following section:

 

     39-3-43. Kent County Water Authority. – (a) Notwithstanding any special or general

law to the contrary, the Kent County Water Authority, absent a force majeure, shall provide

qualified biotechnology manufacturing facilities located in the Kent County Water district with

uninterrupted water supply, provided said supply is not less than eight hundred thousand

(800,000) gallons per day. This section shall not limit water intended for public health and safety

including residential use, non-residential sanitary uses and fire response.

     (b) The Kent County Water Authority shall forthwith develop and implement water

conservation efforts pursuant to section 1.7.3 of the revised Rules and Regulations of the Kent

County Water Authority.

     (c) The Kent County Water Authority shall provide a written report to the speaker of the

house, the senate president, and chairmen of the house and senate committees on finance detailing

compliance with the provisions of this act no later than October 1, 2006, and on the first day of

October in each subsequent year during the effective term of this act.

     (d) For the purposes of this section, the following words and phrases shall be defined as

follows:

     (1) "Biotechnology manufacturing facility" means the manufacturing facilities of a

company primarily engaged in commercial biological research, development, manufacturing or

the sale of biotechnology products.

     (2) "Qualified" means a biotechnology company with existing manufacturing facilities

located within the Kent County Water District as of January 1, 2006.

 

     SECTION 2. This act shall take effect upon passage and shall be repealed in its entirety

on March 1, 2011.
