H O U S E  R E S O L U T I O N

REQUESTING THE DEM AND THE DOA TO ASSESS THE EFFECTS UPON THE ENTIRE STATE'S FISHERY BY THE ENACTMENT OF THE MAGNUSON-STEVENS FISHERY CONSERVATION AND MANAGEMENT AMENDMENT ACT OF 2005

     RESOLVED, That this House of Representatives of the State of Rhode Island and

Providence Plantations hereby requests the Rhode Island Department of Environmental

Management (DEM) and the Rhode Island Department of Administration (DOA) assess the

effects upon the entire State of Rhode Island fishery by the enactment of the "Magnuson-Stevens

Fishery Conservation and Management Act" also known as the "Fishery Conservation and

Management Amendment Act of 2005 for fiscal years 2006 through 2010"; and be it further

     RESOLVED, That this House requests the DEM to report the particular effects to the

fishery, of Section 17, entitled "Fishery Permitting and Registration," found in the version of the

Act posted on 12/12/2005 on the NOAA (National Oceanic and Atmospheric Administration)

Fishery Features Website; and be it further

     RESOLVED, That this House requests the DEM prepare a report on its progress and/or

establish a reporting schedule to comply with the Magnuson-Stevens Act, thereby enabling

possible exemptions for certain Rhode Island fisheries or water related industries from Federal

mandated fees; and be it further

     RESOLVED, That the House requests the DOA and the DEM to make a report to the

House Finance committee with its findings and compliance reporting schedules or plans on or

before March 16, 2006; and be it further

     RESOLVED, That the Secretary of State be and he hereby is authorized and directed to

transmit duly certified copies of this resolution to the Director of the Rhode Island Department of

Administration, the Director of the Rhode Island Department of Environmental Management, and

the Rhode Island House of Representatives Fiscal Advisor.
