J O I N T  R E S O L U T I O N

RELATING TO ACQUISITION OF LAND - GENERAL ASSEMBLY LEASE APPROVAL - JOINT RESOLUTIONS

     SECTION 1. This Joint Resolution is submitted pursuant to Rhode Island general laws

subsection 37-6-2(d).

     SECTION 2. General Assembly Lease Approval – Department of Human Services

Pawtucket Regional Family Center.

     WHEREAS, The department of human services currently holds a sublease agreement

with the city of Pawtucket which will expire on June 30, 2007; and

     WHEREAS, The department of human services wishes to renew, for the period of five

(5) years, the sublease agreement with the city of Pawtucket; and

     WHEREAS, The city of Pawtucket has a current lease, in full force and effect, with

Kellaway Realty Corporation of Randolph, Massachusetts; and

     WHEREAS, The city of Pawtucket attests to the fact that there are no clauses in the lease

agreement with Kellaway Realty Corporation that would interfere with the department of human

services' sublease agreement or use of the facility; and

     WHEREAS, The department of human services now occupies fifty percent (50%) of the

total 18,000 square feet, more or less, of the building located at 24 Commerce Street in

Pawtucket, Rhode Island; and

     WHEREAS, The Pawtucket Regional Family Center and its programs housed in this

location would be difficult to relocate to a different facility due to the nature of the General

Public Assistance (GPA) clients and others with social service needs who frequent the offices;

and

     WHEREAS, It is crucial that such services be provided in a location easily accessible to

the client population by means of public transportation; and

     WHEREAS, The state's obligation is fifty percent (50%) of the annual rental cost, and

monthly payments include taxes, electric, parking, and heat; and

     WHEREAS, The cost of the Sublease Agreement in the current fiscal year, ending June

30, 2007, is $135,520, or $7.53 per square foot; and

     WHEREAS, The annual cost of the Sublease Agreement in each of the five (5) years of

the term is not to exceed the following schedule: $150,660 in the year ending June 30, 2008;

$155,160 in the year ending June 30, 2009; $159,840 in the year ending June 30, 2010; $164,610

in the year ending June 30, 2011; and $169,560 in the year ending June 30, 2012, where this

schedule represents an average cost increase of three percent (3.0%) per year; and

     WHEREAS, The payment of the Sublease Agreement will be made from funds not

available to the department of human services for the payments of rental and lease costs, without

additional appropriations on the part of the general assembly; and

     WHEREAS, At a meeting duly noticed on June 12, 2007, the state properties committee

considered the siting criteria for leased facilities under Rhode Island general laws subsection 37-

6-2(b), found that site met all relevant criteria and that the lease cost was at or below a reasonable

market rate; and

     WHEREAS, The state properties committee now respectfully requests the approval of the

Rhode Island House of Representatives and the Rhode Island Senate for the Sublease Agreement

between the department of human services and the city of Pawtucket for the facility located at 24

Commerce Street in Pawtucket, Rhode Island; now, therefore be it

     RESOLVED, That the general assembly of the state of Rhode Island and Providence

Plantations hereby approves the Sublease Agreement, for a term not to exceed five (5) years and

at a total cost of no more than $799,830; and be it further

     RESOLVED, That this Joint Resolution shall take effect upon passage by this general

assembly; and be it further

     RESOLVED, That the secretary of state be and he hereby is authorized and directed to

transmit duly certified copies of this resolution to Governor Donald Carcieri, the director of the

department of human services, the director of the department of administration, the state budget

officer and the chair of the state properties committee.
