A N A C T

RELATING TO TOWNS AND CITIES -- HISTORICAL ZONING

It is enacted by the General Assembly as follows:

 

     SECTION 1. Section 45-24.1-10 of the General Laws in Chapter 45-24.1 entitled

"Historical Area Zoning" is hereby amended to read as follows:

 

     45-24.1-10. Enforcement. – (a) Any authorized local official or any local building

official may bring an action against any property owner who fails to comply with the

requirements of section 45-24.1-4. Actions shall be brought in the superior court having

jurisdiction where the violation occurred or is likely to occur; provided, that where the violation

has occurred, or is likely to occur in the city of Providence, the action shall be brought in the

municipal housing court in the city. Plaintiffs may seek restraining orders and injunctive relief to

restrain and enjoin violations or threatened violations of this chapter.

     (b) Provided, further, that every person who shall have any historical building, or portion

of a historical building demolished without the requisite permits as required by chapter 45-24.1

shall be guilty of a misdemeanor and upon conviction shall be punished by a fine not exceeding

five hundred dollars ($500) and/or imprisonment of up to one year.\

 

     SECTION 2. This act shall take effect upon passage.
