RELATING
TO BUSINESSES AND PROFESSIONS - PHARMACIES

It is enacted by the General Assembly as
follows:
SECTION 1. Section
5-19.1-3 of the General Laws in Chapter 5-19.1 entitled
"Pharmacies" is hereby amended to read
as follows:
5-19.1-3.
State board of pharmacy -- Creation -- Membership -- Oath -- Vacancies. -
- (a) Within the department of health, there
shall be a board of pharmacy, consisting of nine (9)
individuals, residents of the state of Rhode
Island, one of whom shall be a registered pharmacist
who is currently employed in the department of
pharmacy at a hospital corporation in the state of
Rhode Island during his or her term of
appointment; two (2) of whom shall be actively engaged in
the practice of independent retail pharmacy; two
(2) of whom shall be representatives of the
Rhode Island drug chain stores; two (2) of whom
shall be actively engaged in any field of
pharmacy practice; and two (2) of whom shall be
from the public. All members, except the public
members, shall be registered pharmacists and
shall have been a licensed pharmacist for five (5)
consecutive years in the state of Rhode Island
immediately prior to appointment.
(b) Members of
the board shall hold office for a term of three (3) years. Appointment of
members shall occur as individual appointments
expire, such that the composition of the board
will not be altered. All appointments shall be
made by the director of health with the approval of
the governor.
(c) No person who
has been appointed to and served for two (2) three (3) full
consecutive three (3) year terms shall be eligible
for appointment to the board.
(d) Each member
shall qualify by taking the usual oath of a state officer, which shall be
filed with the secretary of state, and each
member shall hold office for the term of his or her
appointment and until his or her successor is
appointed and qualified.
(e) In the
case of the resignation or disqualification of a member, or a vacancy occurring
from any cause, the director shall appoint a
successor for the unexpired term.
SECTION 2. This
act shall take effect upon passage.
