A N  A C T

RELATING TO AUTHORIZATION FOR SANITARY SEWER LINE FROM BONNET SHORES BEACH CLUB CONDOMINIUM TO TOWN OF NARRAGANSETT WASTEWATER TREATMENT SYSTEM

It is enacted by the General Assembly as follows:

 

     SECTION 1. Notwithstanding any other state law or regulation to the contrary, the

Bonnet Shores Beach Club Condominium Association, Inc. is hereby authorized to construct, use,

operate, maintain and repair a sanitary sewer line (and any necessary pumping or lift station

equipment) connecting the Bonnet Shores Beach Club Condominium property located at 175

Bonnet Point Road, Narragansett, Rhode Island, to the Town of Narragansett wastewater

collection and treatment system. Such sewer line shall allow for the discharge of sanitary sewage

from the Bonnet Shores Beach Club Condominium to the Town of Narragansett wastewater

collection and treatment system in lieu of existing on-site wastewater treatment and disposal.

     SECTION 2. The construction, use, operation, maintenance and repair of such sanitary

sewer line shall be subject to the issuance of all required state and local approvals, permits and

licenses to the extent not inconsistent with the foregoing authorization.

     SECTION 3. The foregoing authorization is and shall remain conditioned upon no

creation of additional units in the Bonnet Shores Beach Club Condominium beyond the number

of units declared and constructed in the Bonnet Shores Beach Club Condominium as of January

1, 2009.

     SECTION 4. Any connection to such sewer line from any property other than from the

Bonnet Shores Beach Club Condominium shall be allowed by the Town of Narragansett only as a

replacement for an on-site wastewater treatment and disposal system at such other property in

existence as of January 1, 2009.

     SECTION 5. In the event of the issuance of any final decision by the U.S. Department of

Commerce or the National Oceanic and Atmospheric Administration (NOAA) that the continued

provision of funds by said Department or NOAA to the Rhode Island Coastal Resources

Management Council is to be terminated, reduced, or negatively amended as a result of the

passage of this act, this act shall then be deemed to be null and void and of no further effect.

     SECTION 6. This act shall take effect upon passage.
