A N   A C T

IN AMENDMENT OF SECTION VII(I) OF CHAPTER 330 OF THE 1991 PUBLIC LAWS ENTITLED "AN ACT AUTHORIZING THE TOWNS OF BRISTOL AND WARREN TO ESTABLISH A REGIONAL SCHOOL DISTRICT"

It is enacted by the General Assembly as follows:

 

SECTION 1. Section VII(I) of Chapter 330 of the 1991 Public Laws entitled "An Act Authorizing the Towns of Bristol and Warren to Establish a Regional School District" is hereby amended as follows:

VII(I) Means of Apportioning Expenses

            The total education costs of the regional district shall be apportioned between the towns based upon a per public pupil calculation, using enrollment as of the prior October 1 a rolling average per public pupil calculation over the thirteen (13) school years prior to each fiscal year's budget. For purposes of calculating such rolling average, beginning with the 2014-2015 school year and going forward, the average daily membership (ADM) of enrollments, as reported to the state on the last day of the previous school year shall be used. For school years prior to 2014-2015, the prior October 1 enrollment census shall be used in calculating the rolling average. On or before the second Monday in May, the treasurer of the regional district shall determine the proportionate share of the costs of the regional district for the next fiscal year to be borne by the towns and shall notify the treasurer of towns of the total amount.

            Each of the treasurers of the respective towns shall transfer one-twelfth of the town's portion of local funds for the regional district to the treasurer of the regional district on the first business day of each and every month beginning with the month of July, between the hours of 9:00 a.m. and 2:00 p.m.

            A daily penalty charge shall be assessed by the regional committee for late payment of the town's portion for operation aid to be based on the Donoghue Money Fund Report rate plus one-fourth of one percent.

SECTION 2. If any provision of this act, or the application thereof to the towns of Bristol and Warren or to any person or circumstances, is deemed invalid for any reason, the remainder of this act, or the application of such provision to said towns or other persons or circumstances, shall not be affected thereby and, to this end, the provisions of this act are declared to be severable.

SECTION 3. This act shall take effect upon passage.
