It is enacted by the General Assembly as follows
SECTION 1. Section 5-45-12 of the General Laws in Chapter 5-45 entitled "Nursing Home Administrators" is hereby amended to read as follows:
5-45-12. Disciplinary proceedings -- Grounds for discipline.
-- The department may suspend or revoke any license issued under
this chapter or may reprimand, censure, or otherwise discipline in
accordance with the provisions of this section upon decision and after
hearing as provided by chapter 35 of title 42, as amended, {ADD upon
proof that the licensee engaged in unprofessional conduct which
includes, but is not limited to, ADD} {DEL in DEL} any of the following {DEL cases DEL} :
(1) {DEL Upon proof that the licensee is DEL} {ADD Has become ADD} unfit or
incompetent by reason of negligence, habits, or other causes;
(2) {DEL Upon proof that the licensee has willfully or repeatedly
violated DEL} {ADD Is in violation of ADD} any of the provisions of this
chapter or the rules enacted in accordance therewith; or {DEL willfully
or repeatedly DEL} acted in a manner inconsistent with the health and
safety of the patients of the home in which he or she is the
administrator;
(3) {DEL Upon proof that the licensee is guilty of DEL} {ADD Has engaged
in ADD} fraud or deceit in the practice of nursing home administration or
in his or her admission to such practice;
(4) {DEL Upon proof that the licensee h DEL} {ADD H ADD} as been convicted in a
court of competent jurisdiction, either within or without this state,
of a felony.
{ADD (5) Failed to conform to minimal standards of acceptable and prevailing practice of nursing home administration. ADD}
SECTION 2. This act shall take effect upon passage.
