AN ACT RELATING TO BUSINESSES AND PROFESSIONS -- PHARMACY

It is enacted by the General Assembly as follows

SECTION 1. Section 5-19-28 of the General Laws in Chapter 5-19 entitled "Pharmacy" is hereby amended to read as follows:

5-19-28. License for pharmacy within medical institution. -- {ADD (a) ADD} No person shall operate, conduct, maintain, open, or establish a pharmacy within any hospital, sanatorium, clinic, or dispensary, in which drugs, medicines, and poisons are compounded or dispensed without, first obtaining a license so to do from the board of pharmacy.

{ADD (b) Clinic pharmacies operated by a health maintenance organization licensed under chapter 27-41 and this chapter may refill prescriptions which have been previously dispensed by another health maintenance organization clinic pharmacy, provided that prior to dispensing a refill the pharmacy refilling the prescription verifies the appropriateness of the refill through a centralized database of that health maintenance organization.

(c) Disclosure of prescription information to any other person(s), other than agents of properly licensed pharmacies pursuant to section (b), is prohibited. ADD}

SECTION 2. This act shall take effect upon passage.
