AN ACT RELATING TO LABOR AND LABOR RELATIONS

It is enacted by the General Assembly as follows:

SECTION 1. Title 28 of the General Laws entitled "LABOR AND LABOR RELATIONS" is hereby amended by adding thereto the following chapter:

{ADD CHAPTER 6.9
EMPLOYER REQUESTS FOR TAX AND INCOME INFORMATION FROM APPLICANTS PROHIBITED
ADD}

{ADD 28-6.9-1. Requests for tax returns prohibited. -- ADD} {ADD No employer or agent of any employer shall request or require any applicant for employment to provide copies of his or her federal or state income tax return, W-2 statement or related tax documents as a condition of consideration for employment.ADD}

{ADD28-6.9-2. Penalties for violations. -- ADD} {ADD In any civil action alleging a violation of this chapter, the court may: ADD}

{ADD (1) Award to a prevailing applicant punitive damages in addition to any award of actual damages and reasonable attorney's fees and costs; and ADD}

{ADD (2) Afford injunctive relief against any employer or agent of any employer who commits or proposes to commit a violation of this chapter. ADD}

SECTION 2. This act shall take effect upon passage.
