AN ACT RELATING TO CRIMINAL OFFENSES -- NUISANCES

It is enacted by the General Assembly as follows

SECTION 1. Section 11-30-4 of the General Laws in Chapter 11-30 entitled "Nuisances" is hereby amended to read as follows:

11-30-4. Penalty for nuisance involving intoxicating liquors. -- Every person keeping or maintaining any common nuisance enumerated in section 11-30-2, or aiding in so doing, shall for the first offense be punished by a fine of not more than {DEL one hundred dollars ($100) DEL} {ADD six hundred dollars ($600) ADD} , {DEL for a second offense shall be fined not more than three hundred dollars ($300), DEL} and for a {DEL third DEL} {ADD second ADD} and each subsequent offense shall be fined not more than {DEL five hundred dollars ($500) DEL} one thousand dollars ($1,000) ADD} or be imprisoned for not more than {DEL one year DEL} {ADD two (2) years ADD} in the adult correctional institutions, or both, in the discretion of the court. Money arising from fines imposed under this section shall be paid one-half (1/2) to the general treasurer of the state and one-half (1/2) to the treasurer of the town or city where the offense occurred.

SECTION 2. This act shall take effect upon passage.
