AN ACT RELATING TO SCENIC HIGHWAYS

It is enacted by the General Assembly as follows:

SECTION 1. Sections 24-15-3 and 24-15-4 of the General Laws in Chapter 24-15 entitled "SCENIC HIGHWAYS" are hereby amended to read as follows:

24-15-3. Designation as a scenic highway. -- The director, or the governing body of any municipality{DEL , DEL} {ADD as to any highway (including a state highway) within its borders, ADD} may apply to the board for the designation of {DEL any DEL} {ADD a ADD} highway {DEL under its jurisdiction DEL} as a scenic highway. {ADD A municipality making application for a state highway shall notify the director of the Rhode Island department of transportation. The director shall have thirty (30) days to comment on the application after holding a public hearing. ADD} The board shall approve or deny the application for designation of a highway as a scenic highway submitted under this {DEL sub-section DEL}{ADD section ADD}.

24-15-4. Withdrawal of highways from scenic highways system. -- {DEL After holding a public meeting, the DEL} {ADD After holding a public hearing, the ADD} director, or the governing body of any municipality{DEL , DEL} {ADD as to any scenic highway (including a state highway) within its borders, ADD} {DEL which has jurisdiction over a scenic highway DEL} may apply to the board for{ADD , and the board itself may propose, ADD} the removal of a highway from the scenic highway system. The board shall {ADD thereupon ADD} approve or deny the {DEL application for DEL} removal of the highway from its designation as a scenic highway.

SECTION 2. This act shall take effect upon passage.
