J O I N T  R E S O L U T I O N

CREATING A SPECIAL LEGISLATIVE COMMISSION TO STUDY THE FEASIBILITY OF GRAFFITI PROOF AEROSOL SPRAY PAINT CONTAINERS AS A POTENTIAL SOLUTION TO GRAFFITI

RESOLVED, That a special legislative commission be and the same is hereby created consisting of seven (7) members one (1) of whom shall be the director of the department of health, or designee, to serve as chair; one (1) of whom shall be a representative from the paint industry; one (1) of whom shall be an owner of a retail outlet that sells aerosol spray paint; one (1) of whom shall be an economist with working knowledge of the spray paint industry; one (1) of whom shall be an engineer with broad-based technical education and experience; one (1) of whom shall be a representative from law enforcement; and one (1) of whom shall be a city official that directs the city's graffiti abatement department, or designee. The director of the department of health, or designee, shall appoint the members of the commission within sixty (60) days after the effective date of this act.

Participation in the commission shall be voluntary. In lieu of any appointment of a member of the legislature to a permanent advisory commission, a legislative study commission, or any commission created by a general assembly resolution, the appointing authority may appoint a member of the general public to serve in lieu of a legislator, provided that the majority leader or the minority leader of the political party which is entitled to the appointment consents to the appointment of the member of the general public.

The purpose of said commission shall be to analyze the technical and economic feasibility of graffiti-proof aerosol spray paint container technologies for future commercial production and use and to evaluate the viability of such containers as a potential solution to graffiti, which is defined as "inscriptions, drawings, lettering or designs which are painted, sprayed or placed on a surface without the consent of the owner so as to be seen by the public".

Forthwith upon passage of this resolution, the members of the commission shall meet at the call of the speaker of the house. Vacancies in said commission shall be filled in like manner as the original appointment.

The membership of said commission shall receive no compensation for their services.

All departments and agencies of the state shall furnish such advice and information, documentary and otherwise, to said commission and its agents as is deemed necessary or desirable by the commission to facilitate the purposes of this resolution.

The speaker of the house is hereby authorized and directed to provide suitable quarters for said commission; and be it further

RESOLVED, That the commission shall submit a report of its findings and recommendations to the chairmen of both the house and senate judiciary committees no later than three hundred (300) days after the effective date of this act.
