It is enacted by the General Assembly as follows:
SECTION 1. Section 28-39-3 of the General Laws in Chapter 28-39 entitled "Temporary Disability Insurance -- General Provisions" is hereby amended to read as follows:
28-39-3. Exemption of governmental entities. --
Governmental entities as defined in section 28-42-3(21) shall
not be deemed to be employing units subject to chapters 39 --
41 of this title and services performed in the employ of those
governmental entities shall not be deemed to be employment subject
to those chapters; provided, however, that certain governmental
entities may elect to become subject to chapters 39 -- 41 of this
title in accordance with sections 28-39-3.1 and 28-39-3.2 {DEL ;
provided, further, however, that the state of Rhode Island, its
instrumentalities, and other state related instrumentalities shall
not be eligible to elect that coverage DEL} {ADD Provided, however, that unionized state employees may elect to become subject to chapters 39-41 of this title through the collective bargaining process ADD}.
SECTION 2. This act shall take effect upon passage.
