It is enacted by the General Assembly as follows:
SECTION 1. Title 5 of the General Laws entitled "Businesses and Professions" is hereby amended by adding thereto the following chapter:
{ADD 5-73-1. Definitions. -- ADD} {ADD As used in this chapter, the following terms shall have the following meanings: ADD}
{ADD (1) "Department" shall mean the department of administration of the state of Rhode Island. ADD}
{ADD (2) "Roofing contractor" shall mean any person or entity engaged in the state of Rhode Island in the business of commercial or industrial roofing, or any combination thereof. ADD}
{ADD (3) "Roofing" shall mean and include any and all construction, renovation or other work performed on or about the roof, as such term is commonly used, of any nonresidential structure or like building and shall specifically include sealing, water proofing, weatherproofing, related sheet metal work, and the like. ADD}
{ADD (4) "Nonresidential structure" shall mean and include any and all commercial or industrial structures or buildings, and shall not include any residential structures consisting of four (4) dwelling units or less as such terms are defined in section 5-65-1(3) and (5). ADD}
{ADD 5-73-2. Purpose. -- ADD} {ADD The purpose of this act is to promote public safety, health and welfare by providing a mechanism to ensure that all roofing contractors conducting business in the state of Rhode Island have the requisite skills, training and experience necessary to safely and adequately conduct roofing activities within this state. ADD}
{ADD 5-73-3. Registration of roofing contractors. -- ADD} {ADD All roofing contractors, in addition to the requirements of chapter 6-65 of the general laws entitled "Contractor's Registration", if applicable, prior to conducting roofing business in the state of Rhode Island, shall first submit an application to the department on such form or forms as the department may require. Such application shall include the following information: ADD}
{ADD (1) the name of the applicant; ADD}
{ADD (2) the business address of the applicant; ADD}
{ADD (3) the mailing address of the applicant; ADD}
{ADD (4) the telephone number of the applicant; ADD}
{ADD (5) the name of the party or officer who shall be responsible for all roofing activities conducted in the state of Rhode Island ADD}
{ADD (6) any registration number and/or other license numbers issued by the state, or any city or town; and ADD}
{ADD (7) a statement of the skills, training and experience of the applicant sufficient to ensure public safety, health and welfare. ADD}
{ADD(8) The registration requirements of this secion shall not apply to roofing contractors applying shingles only.ADD}
{ADD 5-73-4. Registration fee. -- ADD} {ADD All roofing contractors shall submit a payment in the amount of five hundred dollars ($500) representing a registration fee along with the application referenced in section 5-73-3 ADD}
SECTION 2. This act shall take effect upon passage.
