A N     A C T

RELATING TO HEALTH AND SAFETY -- CEMETERIES -- SCATTERING OF ASHES

It is enacted by the General Assembly as follows:

SECTION 1. Chapter 23-18 of the General Laws entitled "Cemeteries" is hereby amended by adding thereto the following section:

{ADD 23-18-2.1. Cremated human remains. -- ADD} {ADD (a) If a cemetery has rules or regulations in effect regarding the disposition of cremated human remains on or in cemetery property, such rules and regulations, if not contrary to law, shall be binding on all interested parties. ADD}

{ADD (b) The scattering of cremated human remains within a cemetery shall be prohibited except within a specific area designated for such purpose. Violation of this subsection shall be punishable by a fine of not to exceed five hundred dollars ($500). ADD}

{ADD (c) Nothing in this section shall be construed to require a cemetery to authorize the scattering of ashes when said practice is contrary to the religious beliefs associated with the cemetery. ADD}

SECTION 2. This act shall take effect upon passage.
