A N     A C T

RELATING TO TOWN MEETINGS

It is enacted by the General Assembly as follows:

SECTION 1. Section 45-3-25 of the General Laws in Chapter 45-3 entitled "Town Meetings" is hereby amended to read as follows:

45-3-25. Voting machines for municipal budget referenda. -- (a) At the request of the council of a city or town {DELand at the sole expense of the city or town,DEL} the board of elections shall furnish a sufficient number of voting machines for use in connection with votes to be taken at any municipal budget referenda. {DELThe city or town shall furnish to the board of elections, no later than ten (10) days prior to the date of the municipal budget referenda, ballot labels containing the items to be voted upon at the municipal budget referenda, which ballot labels shall be suitable for affixation to the face of the voting machines.DEL}{ADDAny such request shall be made to the board of elections not later than fifteen (15) days prior to the date of the municipal budget referenda.ADD}

(b) Nothing herein contained shall be deemed to make the provisions of title 17 applicable to municipal budget referenda.

SECTION 2. Chapter 17-19 of the General Laws entitled "Conduct of Election and Voting Equipment, and Supplies" is hereby amended by adding thereto the following section:

{ADD 17-19-4.2. Moderator request -- Computerized voting machines. -- ADD}{ADD (a) Upon request of a moderator charged with conducting municipal or regional school financial meeting, the board of elections will furnish each meeting to be conducted with one (1) computerized voting machine per year, and voting booths and ballots marked yes and no at the state's expense. Said request shall declare the number of ballots requested and the number of anticipated voters. The request shall be delivered to the board of elections no later than fifteen (15) days prior to said meeting. The board of elections shall determine the need for additional computerized machines and the cost thereof shall be borne by the municipality or school district. ADD}

{ADD(b)If a municipality or school district holds more than one (1) financial meeting in the same calendar year, the municipality or school district shall bear the cost of any computerized machines, voting booths and ballots furnished for use at any such additional financial meetings.ADD}

SECTION 3. This act shall take effect upon passage.
