RELATING TO LABOR AND LABOR RELATIONS -- TEMPORARY EMPLOYEE PROTECTION ACT

It is enacted by the General Assembly as follows:

SECTION 1. Title 28 of the General Laws entitled "Labor and Labor Relations" is hereby amended by adding thereto the following chapter:

THE TEMPORARY EMPLOYEE PROTECTION ACT

{ADD 28-6.10-1. Statement of Policy. -- ADD} {ADD It is hereby declared to be the public policy of this state to foster the employment of all individuals in the state including temporary employees working for any employment agency, placement service, training school or center, labor organization, or any other employee referring source and to safeguard their right to obtain and hold employment without discrimination. ADD}

{ADD 28-6.10-2. Definitions. -- ADD} {ADD When used in the chapter: ADD}

{ADD (1) "Employment agency" includes any person undertaking with or without compensation to procure opportunities to work, or to procure, recruit, refer, or place employees. ADD}

{ADD (2) "Temporary employee" includes any person working for or obtaining employment pursuant to an agreement with any employment agency, placement service, training school or center, labor organization, or any other employee referring source. ADD}

{ADD (3) "Labor organization" includes any organization which exists for the purpose in whole or in part, of collective bargaining or of dealing with employers concerning grievances, terms of conditions of employment or of other mutual aid or protection in relation to employment. ADD}

{ADD 28-6.10-3 Job description notification. --ADD} {ADD Before any worker is given any new job assignment regardless if the assignment is with the same contracting company, employment agencies shall provide their employees with the opportunity to see and have a copy of a written notice that includes a job description with classification requirements, anticipated pay rate, benefits and work schedules. A copy of the job description shall be kept on file by the employment agency and be available to the employees. ADD}

{ADD SECTION 2.ADD} A Joint Legislative Commission shall be appointed and exist until December 2000 to recommend improvements to temporary employment practices. The commission shall consist of sixteen (16) members all of whom shall be citizens and residents of the state; three (3) of whom shall be members of the house of representatives, not more than two (2) from the same political party, to be appointed by the speaker; three (3) of whom shall be members of the senate, not more than two (2) from the same political party, to be appointed by the majority leader; two (2) of whom shall be individuals employed as temporary employees, to be appointed by the speaker; the director of the department of labor and training, or his or her designee; the director of the department of administration, or his or her designee; the President of the Rhode Island AFL - CIO, or his or her designee; the President of Progresso Latino, or his or her designee, the president of the Greater Providence Chamber of Commerce, or his or her designee; the president of the Northern Rhode Island Chamber of Commerce, or his or her designee; the state director the National Federation of Independent Business, or his or her designee; and the executive director of the Rhode Island Staffing Service Association, or his or her designee. {ADD SECTION 3.ADD} This act shall take effect upon passage. ADD}
