S  E  N  A  T  E     R  E  S  O  L  U  T  I  O  N

REQUESTING AMTRAK TO REPAIR A RETAINING WALL AT KIMBERLY VILLAGE CONDOMINIUM

WHEREAS, The health, safety and welfare of the citizens of the City of Warwick are matters of paramount importance to the Senate of the State of Rhode Island; and

WHEREAS, The Amtrak line runs adjacent to property occupied by the Kimberly Village Condominium; and

WHEREAS, The condominium complex is composed of three buildings. One building which abuts and runs parallel to the Amtrak railroad line is sustaining damage due to excessive shifting and settling; and

WHEREAS, The condominium association has retained the services of a local engineering firm, which has evaluated the situation and attributed the problem to two primary factors. First, the failure of a wood retaining wall between Kimberly Village Condominium and the railroad track, and second is the shifting of subsoil in one location which would be minimized if the retaining wall were repaired and rebuilt; and

WHEREAS, Kimberly Village Condominium is requesting Amtrak to replace the entire retaining wall that separates the two properties; now, therefore be it

RESOLVED, That this Senate of the State of Rhode Island and Providence Plantations hereby supports the request to Amtrak and further requests that Amtrak replace the retaining wall which separates the Amtrak railroad line from Kimberly Village Condominium on 4156-4160 Post Road, Warwick, Rhode Island; and be it further

RESOLVED, That the Secretary of State be and he hereby is authorized and directed to transmit duly certified copies of this resolution to the Amtrak Corporation and the entire Congressional Delegation of the State of Rhode Island.
