§ 27-30-12 Enforcement.
The commissioner may, after notice and hearing, issue rules and regulations as
the commissioner deems appropriate for the supervision of this chapter.
Whenever the commissioner finds that there has been a violation of this chapter
or any rules or regulations issued pursuant to it, after written notice of the
violation and hearing given to the insurer or other person authorized or
licensed by the commissioner, he or she shall set forth the details of the
findings together with an order for compliance by a specified date. The order
shall be binding on the insurer and other persons authorized or licensed by the
commissioner on the specified date unless sooner withdrawn by the commissioner
or a stay from the order has been ordered by a court of competent jurisdiction.
The commissioner may set forth by regulation prima facie reasonable premium
rates, together with corresponding safe-harbor benefit provisions, which
premium rates shall be conclusively presumed reasonable in relation to the
benefits provided when used for policies containing such benefit provisions.
