§ 28-21-17 Penalties.
In addition to and not in lieu of the remedies available to employees under
§ 28-21-8(4), any employer who shall willfully and intentionally violate
the requirements of this chapter shall be subject to a fine imposed by the
department of labor and training at the rate of not more than five thousand
dollars ($5,000) for every day the violation exists. The department may impose
the fines and enforce their collection by means of a civil action against the
employer and the responsible officers of the employer. In addition, for any
violation of this chapter which is willful and intentional and which is
committed with disregard for the safety of employees, the responsible officer
or officers of any offending employer shall be guilty of a misdemeanor and
shall be imprisoned for a period not to exceed one year for each violation.
